TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using KakatitaFarms.com (the “Site”) and purchasing products from Kakatiya Farms, Inc. (“Kakatiya Farms,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Site or purchase products.

2. Changes to Terms

We may modify these Terms at any time. Changes become effective when posted. Continued use of the Site after changes constitutes acceptance. We will post the “Last updated” date at the top.

3. Eligibility and Accounts

You must be at least 18 years old to use the Site or purchase products. By creating an account, you represent and warrant that you are 18+ and that information you provide is accurate, up-to-date, and complete. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. Notify us immediately of any unauthorized use.

4. Products, Orders, and Pricing

a. Product Descriptions — We attempt to be accurate but do not guarantee descriptions, images, or availability.  

b. Orders — All orders are subject to acceptance by Kakatiya Farms. We may refuse or cancel orders for any reason, including pricing errors, limited inventory, or suspicion of fraud.  

c. Pricing & Payment — Prices are displayed on the Site and may change without notice. Payment is due at purchase. We accept payment methods displayed on the Site. You authorize us to charge your chosen payment method.  

d. Shipping & Risk of Loss — Shipping policies, costs, and estimated delivery times are posted on the Site. Risk of loss transfers to you upon delivery to the carrier unless otherwise stated.  

e. Returns & Refunds — Our return, refund, and cancellation policies are posted on the Site. Those policies govern returns and refunds.

5. Taxes

You are responsible for any applicable taxes, duties, or fees related to purchases. We may collect taxes where required by law.

6. User Content and Reviews

a. Allowed Content — Users may submit reviews, photos, and other content (“User Content”). You retain ownership of your User Content but grant Kakatiya Farms a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display such content in connection with our business.  

b. Restrictions — You will not post unlawful, defamatory, infringing, obscene, or otherwise objectionable content. Do not post private information of others.  

c. Moderation & Removal — We may, but are not required to, monitor, edit, or remove User Content for any reason.

7. Intellectual Property

All Site content, trademarks, logos, product images, text, code, and other materials are our property or licensed to us and protected by intellectual property laws. You may not copy, reproduce, distribute, create derivative works from, or exploit Site content without our prior written permission.

8. Prohibited Uses

You agree not to: (a) use the Site for unlawful purposes; (b) interfere with Site security or operations; (c) attempt to access other users’ accounts; (d) upload malware; or (e) scrape or harvest data from the Site without permission.

9. Third-Party Links and Services

The Site may contain links to third-party websites, products, or services. We do not endorse or control third-party content and are not responsible for it. Use of third-party services is at your own risk and subject to their terms.

10. Disclaimers; No Warranties

THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAKATIYA FARMS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES IS LIMITED TO THE AMOUNT PAID BY YOU FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Kakatiya Farms and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your User Content, or your use of the Site.

13. Privacy

Our Privacy Policy explains how we collect, use, and disclose information. By using the Site, you consent to our Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, U.S., without regard to conflict-of-law rules. You and Kakatiya Farms agree to resolve disputes primarily through binding arbitration under the Federal Arbitration Act and the rules of the American Arbitration Association (or a similar arbitration provider). Arbitration will take place in Los Angeles County, California, unless another location is mutually agreed. YOU AND KAKATIYA FARMS EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING.

15. Exception for Small Claims and Injunctive Relief

Either party may bring an individual action in small claims court for disputes within that court’s jurisdiction. Nothing in these Terms prevents Kakatiya Farms from seeking injunctive relief in court where necessary to protect intellectual property or confidential information.

16. Termination

We may suspend or terminate your access to the Site or your account at any time for breach of these Terms or other reasonable cause. Termination does not limit our other rights or remedies.

18. Severability; Waiver

If any provision of these Terms is held invalid or unenforceable, the remainder will remain in effect. Failure to enforce any provision is not a waiver of that provision.

These Terms, together with our Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and Kakatiya Farms regarding the Site and supersede prior agreements.
